The use of independent contractors in the healthcare industry is not a new trend. However, with the U.S. Department of Labor's recent announcement of a final rule, Employee or Independent Contractor Classification Under the Fair Labor Standards Act, regarding independent contractor classifications, healthcare employers are reminded of the importance of ensuring that their workers are properly classified as either employees or independent contractors. In this interactive webinar, we will discuss the shifting challenges healthcare employers face in this arena. Specifically, we will address:
• Classifying healthcare workers as independent contractors rather than employees;
• Evaluation of the various legal standards;
• Pertinent caselaw and real life examples in the healthcare context; and
• Risks associated with misclassification of workers.
